1. Acceptance of Terms

Welcome to ZI, a mobile application owned and operated by Generation M Holdings (Pty) Ltd ("Gen M," "we," "us," or "our"). By downloading, accessing, or using the ZI application (the "App"), you ("you," "user") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and Gen M. If you do not agree to these Terms, you may not use the App.

2. Description of Service

ZI provides users with information related to cryptocurrency price movements. The App utilizes probabilistic models to generate predictions of potential cryptocurrency price movements over 24-hour and 7-day periods. Based on these predictions, the App provides Buy/Hold/Sell recommendations.

Key features of the service:

  • Price Movement Probabilities: The App displays probabilities associated with potential increases or decreases in cryptocurrency prices.

  • Buy/Hold/Sell Recommendations: The App offers recommendations based on the calculated price movement probabilities.

  • Information Purposes Only: The core function of the app is to provide information to the user.

  • No Financial Advice: Gen M does not provide financial advice.

3. User Responsibilities and Acknowledgements

  • No Financial Advice: You acknowledge and agree that the information provided by the App, including price movement probabilities and Buy/Hold/Sell recommendations, is for informational purposes only and does not constitute financial advice.

  • Independent Decision-Making: You are solely responsible for your own investment decisions. You should conduct your own research and consult with a qualified financial advisor before making any investment decisions.

  • Risk Acknowledgement: You acknowledge that cryptocurrency markets are highly volatile and speculative. The price of cryptocurrencies can fluctuate significantly, and you could lose some or all of your investment. You understand and accept the risks associated with cryptocurrency investments.

  • Accuracy of Information: While Gen M strives to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or timeliness of the information provided by the App. The probabilistic models, assisted by AI, used by the App are based on complex algorithms and involve inherent uncertainties.

  • Use of Data: You are responsible for any data charges incurred while using the App.

  • Account Responsibility: If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Intellectual Property

  • Ownership: The App and its content, including but not limited to the probabilistic models, algorithms, software, design, text, graphics, and trademarks, are owned by Gen M or its licensors and are protected by copyright, trademark, and other intellectual property laws.

  • Limited License: Gen M grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use, subject to these Terms.

  • Restrictions: You may not:

    • Modify, copy, reproduce, republish, upload, post, transmit, or distribute any part of the App or its content.

    • Decompile, reverse engineer, or disassemble the App.

    • Attempt to interfere with the proper functioning of the App.

    • Use the App for any illegal or unauthorized purpose.

    • Remove any copyright, trademark, or other proprietary notices from the App.

5. Disclaimer of Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GEN M DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. GEN M DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION PROVIDED BY THE APP, INCLUDING BUT NOT LIMITED TO PRICE MOVEMENT PROBABILITIES AND BUY/HOLD/SELL RECOMMENDATIONS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GEN M BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR LOSS OF OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF GEN M HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GEN M'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESS TO THE APP.

7. Indemnification

You agree to indemnify, defend, and hold harmless Gen M and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the App, your violation of these Terms, or your violation of any third-party rights.

8. Third-Party Links and Services

The App may contain links to third-party websites or services that are not owned or controlled by Gen M. Gen M does not endorse or assume any responsibility for the content, privacy policies, or practices of any third-party websites or services. You access such third-party websites or services at your own risk.

9. Termination

Gen M may terminate your access to the App at any time, with or without cause, and without prior notice. You may also terminate your use of the App by deleting it from your mobile device. Upon termination, your license to use the App will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.

11. Changes to Terms

Gen M may modify these Terms at any time by posting the updated Terms in the App. Your continued use of the App after the posting of the updated Terms constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically for any updates.

12. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Gen M regarding your use of the App.

  • Waiver: Gen M's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  • Assignment: You may not assign these Terms without the prior written consent of Gen M. Gen M may assign these Terms at any time without notice to you.
